OSHA Porta Potty Requirements for South Carolina Job Sites

OSHA porta potty requirements for construction set a minimum number of toilets by crew size, require washing facilities for some work, and cover farms separately. Here is the rule in plain English, with the official text linked, and what we recommend on top of it.

How many toilets does OSHA require on a construction site?

OSHA requires 1 toilet on a construction site with 20 or fewer workers. Sites with more than 20 workers need 1 toilet seat and 1 urinal per 40 workers. Sites with 200 or more workers need 1 toilet seat and 1 urinal per 50 workers. The rule is 29 CFR 1926.51(c), Table D-1.

Number of employeesMinimum facilities (Table D-1)
20 or fewer1 toilet
20 or more1 toilet seat and 1 urinal per 40 workers
200 or more1 toilet seat and 1 urinal per 50 workers

Read the official text of 29 CFR 1926.51 on osha.gov. South Carolina runs its own OSHA-approved State Plan through the SC Department of Labor, Licensing and Regulation. That plan adopted the federal construction standards, so the same table applies on Spartanburg job sites.

Does OSHA require hand washing stations on job sites?

OSHA 1926.51(f) requires washing facilities on construction sites where workers apply paints, coatings, herbicides or insecticides, or work with other harmful contaminants. The facilities must be close to the work and kept sanitary. Many general contractors place 1 hand wash station per site regardless.

A two-sink hand wash station is refilled at each weekly service visit.

Are mobile crews exempt from the toilet rule?

Mobile crews are exempt from the OSHA toilet count when they have transportation readily available to nearby toilet facilities. The exemption is in 1926.51(c)(4). A paving or utility crew moving every few hours often qualifies. A crew at one site all day does not.

If the crew depends on a gas station restroom miles away, a job site unit is the safer choice.

What does OSHA require for farm workers?

OSHA's field sanitation rule, 29 CFR 1928.110, requires 1 toilet and 1 handwashing facility for every 20 farm workers doing hand labor in the field. Both must be within a quarter-mile walk of each worker. The rule applies to farms with 11 or more employees doing hand labor in the field on any given day.

Read the official text of 29 CFR 1928.110. Orchards and produce farms around Spartanburg County often rent units by the 28-day cycle during harvest.

What do we recommend beyond the OSHA minimum?

We recommend 1 standard unit for every 10 workers on a 40-hour week, which is 4 times the OSHA minimum for a 40-person crew. The OSHA table sets a legal floor. Our number keeps the waste tank from filling before the weekly service visit, which is what crews actually complain about.

OSHA porta potty requirements: common questions

Does OSHA say how often a job site toilet must be cleaned?

The OSHA construction rule requires toilets to be provided and kept sanitary, but it does not set a cleaning schedule. Weekly service is the industry standard. Large crews or summer heat call for 2 visits a week.

Do I need separate toilets for men and women on a job site?

Single-occupancy porta potties with a locking door can be used by anyone. A standard unit meets that need. Larger sites often label units to give women their own.

Who is responsible for providing the toilet, the GC or the subcontractor?

The employer of the workers is responsible under OSHA. On most Spartanburg jobs the general contractor rents the units for everyone, and the contract spells that out.

Can my crew use the homeowner's bathroom instead?

Some homeowners allow it, but many do not, and it can end a job on bad terms. A job site unit keeps crews out of the house and covers the OSHA requirement.
